The Purchaser submitting this order to Littleton Products, Inc. certifies that Purchaser has read the Warranty Information, Waiver of Warranty, and Limitations provisions set out on the website of Littleton Products, Inc., understands the same, and submits this Order for product subject to the terms set out therein.

WARRANTY INFORMATION

LIMITED WARRANTY

Thank you for your interest in the products and services of Littleton Products, Inc. This Limited Warranty applies to physical goods, and only for physical goods, purchased from Littleton Products, Inc. (the "Physical Goods"). All references herein to “Littleton” or “us” shall be deemed to refer to Littleton Products, Inc. All references herein to “you” shall be deemed to refer to the original purchaser of a specific product from Littleton Products, Inc., relating only to each specific purchase.

What does this limited warranty cover?

This Limited Warranty covers any defects in material or workmanship under normal use during the Warranty Period. During the Warranty Period, Littleton Products, Inc. will repair or replace, at no charge, products or parts of a product that prove defective because of improper material or workmanship, under normal use and maintenance. See further Limitations and Waivers of Warranty set forth more specifically below.

NO WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, EXPRESS OR IMPLIED, OR WARRANTIES OF MERCHANTABILITY, EXPRESS OR IMPLIED, ARE OFFERED OR MADE AS TO THIS PRODUCT, AND THE SAME ARE SPECIFICALLY DISCLAIMED AND WAIVED. (SEE BELOW FOR SPECIFICS)

What will we do to correct problems?

Littleton Products, Inc. will either repair the Product at no charge, using new or refurbished replacement parts, or will, at its expense, replace the product. It shall be in the discretion of Littleton Products, Inc. to determine whether or not the defect justifies total replacement.

How long does the coverage last?

The Warranty Period for Physical Goods purchased from Littleton Products, Inc. is 180 days from the date of delivery to you of your original purchase. A replacement Physical Good or part assumes the remaining warranty of the original Physical Good period or 90 days from the date of replacement or repair, whichever is longer.

What does this limited warranty not cover?

This Limited Warranty does not cover any problem that is caused by:

(A) conditions, malfunctions or damage not resulting from defects in material or workmanship, or

(B) conditions, malfunctions or damage resulting from misuse, modification, or abuse of the physical character of the product, or from exceeding the recommended load limits of the product, or

(C) intentional damage to the product.

What do you have to do?

To obtain warranty service, you must first contact us to determine the problem and the most appropriate solution for you and Littleton Products, Inc.

Alleged defects covered by Warranty must be reported in writing to Littleton Products, Inc. by 5:00 p.m. EST on the first day following the last date of the Warranty Period. The Warranty Period starts on the date the product is first delivered to you, and ends at midnight on the 180th day following the start date. If the last day falls on a weekend or legal holiday which has caused Littleton Products, Inc. to be closed, the Warranty Period will be extended through the first business day of Littleton Products, Inc. thereafter. If the warranty claim is delivered in writing by either United States Mail, or by private courier, the Warranty Period required time of notice shall be deemed extended for a period of three full calendar days following the original expiration date of the Warranty Period, to allow reasonable time for delivery.

Warranty claims sent or delivered by email shall not be accepted, and do not constitute notice of claim effectively made.

If Littleton Products, Inc. determines that you have made a valid warranty claim, Littleton Products, Inc. will, within a reasonable time, either:

(A) Repair the product on site, or

(B) Pay the cost of packaging and shipping the product back to Littleton (with you delivering the product at your expense to the shipping origination site) for the purpose of repair, repair the product, and ship the product back to you at its expense, or

(C) Replace the product, with or without return of the original product, as determined by Littleton, or

(D) Refund to you your full original purchase price, with associated shipping charges, in which case you agree to return the product to Littleton at Littleton’s expense according to such method as Littleton determines and instructs.

These duties of Littleton Products, Inc. constitute your sole and total remedies under the warranties offered, and all other duties or liabilities of Littleton Products, Inc. are expressly waived by you.

WARRANTY OF SATISFACTION


Littleton Products, Inc. has provided this product to you without knowledge of your intended use thereof, or your purpose for the product. As set forth below, no warranties of fitness for a particular purpose, or warranties of merchantability (Express of Implied) are offered or made and the same are specifically waived.

However, with the goal of having satisfied purchasers, Littleton Products, Inc., grants to you the following Warranty of Satisfaction.

Upon receipt and inspection of the product, if you (the purchaser) are not satisfied with the quality and appearance of the product, or if for any other reason you are not satisfied, you may return the product to Littleton Products, Inc. for a full refund of the purchase price of the product, excepting therefrom only the packaging and shipping costs paid by you relating to original delivery to you. You are responsible for the costs of shipping the product back to Littleton Products, Inc. at your expense, and the same must be received in at least as good a condition as the product was in upon delivery to you. Use, modification, or damage to the product of any type or extent shall void this warranty of satisfaction.

To exercise your rights under this Warranty of Satisfaction, you must notify Littleton Products, Inc. of your desire to return the product within fifteen days of the date of original delivery to you. That notice must be made in writing and delivered to Littleton Products, Inc. at one of the addresses for notice set out above, and must be received by Littleton Products, Inc. by 5:00 p.m. EST on the fifteenth day following your original delivery date, inclusive of the date of delivery. You must include with that notice a brief statement of the basis of your lack of satisfaction, and include contact information sufficient to allow an agent of Littleton Products, Inc., to contact you with delivery instructions. Upon receipt of the notice, Littleton Products, Inc., through one of its employees or agents, will contact you and provide to you shipping instructions. At that same time you will be provided a claim number, to enable Littleton Products, Inc. and you to readily track and protect the return and claim. Upon receipt of the product in undamaged condition, Littleton Products, Inc. shall within thirty (30) days thereof return to you the original purchase price, with said payment to be made by such method as Littleton Products, Inc. determines to be safe.



WAIVER OF SPECIFIC TYPES OF WARRANTIES AND LIMITATIONS OF DAMAGE

WAIVER OF WARRANTIES OF MERCHANTABILITY

The product provided to you is not intended for resale, rental, or any similar commercial or consumer purpose.

The warranties provided to you do not include any Warranty of Merchantability, and any and all Warranties of Merchantability (Express or Implied) are specifically disclaimed by Littleton Products, Inc. and are deemed waived by you.


WAIVER OF WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE

Littleton Products, Inc. does not know for what purpose you have purchased the product, and cannot and does not assume liability for knowledge of any particular purpose.

All Warranties of Fitness for a Particular Purpose (Express or Implied) are specifically disclaimed by Littleton Products, Inc. and are deemed waived by you.


WAIVER OF IMPLIED WARRANTIES

No Implied Warranties of any type are offered, made, or shall otherwise exist as to the product you have purchased. The only warranties made are the Limited Warranty (as to defects in material or workmanship) and the Warranty of Satisfaction, both of which are stated above. Those warranties are limited to the terms specifically stated.


LIMITATION OF DAMAGES

Littleton Products, Inc. is not, will not, and shall not be responsible for any duties or damages relative to the product or the use thereof, except as specifically and expressly stated herein. Littleton Products, Inc. specifically disclaims any and all liability for claims, causes of action, and damages for personal injury, property damage, loss of use, loss of profit, loss of continuity of business, and other consequential damages of every type arising from use or lack of use of the product, or in any fashion related thereto. Purchaser assumes by acceptance and/or use of the product all risks associated with the same, and shall hold Littleton Products harmless from any and all claims, or causes of action, arising from Purchaser’s use of the product, including defending Littleton Products, Inc. from all such claims.


Limitation to Original Purchaser

THE WARRANTIES PROVIDED TO YOU APPLY ONLY TO THE ORIGINAL PURCHASER OF THE PRODUCT, SHALL NOT SERVE TO PROTECT SUBSEQUENT OWNERS OF THE PRODUCT, AND SHALL BE DEEMED EXTINGUISHED UPON TRANSFER OF THE ORIGINAL PRODUCT TO THE OWNERSHIP OR POSSESSION OF A THIRD PARTY.
